BUDGETS
The Board of Directors recently approved the 2003/2004 Operational and Capital Reserve Budgets. The regular assessments (dues) will remain the same at $520 per year. Of this amount, $350 is allocated to operations and $170 to capital reserve. The budgets will be sent to you in early December, along with the year-end financial report. Your statement for the semi-annual period November through April is enclosed with this mailing.

THE COMMUNITY SCHOOL
In order to annex property into Elkhorn and make it subject to the Master Declaration and the jurisdiction of SVEA, the Master Declaration requires that a document called a Supplemental Declaration be prepared and filed in the public records within a period of time that expired in 1982. Recent searches of the public records show that such a document does not appear to have been filed in the public records for the property in Elkhorn now owned by The Community School. As a result, The Community School is now taking the position that it is not a part of the Elkhorn community and is not subject to the Master Declaration or the jurisdiction of SVEA, even though the school and all previous owners of that property have for many years acted in all respects (paid dues to SVEA, used the SVEA amenities, appeared before the SVEA Architectural Design Committee and the SVEA Board, etc.) as if they were a part of Elkhorn and Subject to the Master Declaration and SVEA. The School has recently filed a suit against SVEA, requesting the Court to determine, in effect, that the school property is not a part of Elkhorn and is not subject to the Master Declaration.

The issue of the School continues to be a difficult one for Elkhorn due to the divided opinions of owners, i.e., those in favor of the School versus those opposed. Your questions and comments on this topic, as well as any other Elkhorn matter, are appreciated.

CANCELLATION OF SPECIAL MEETING
As stated in the letter from the Board that was sent to all members on October 7, 2003, the Special Meeting of the Members scheduled for October 15, 2003 has been canceled. This meeting was for the purpose of voting on amendments of the Master Declaration. Due to the confusion over some of the proposals it has been decided that additional work will be done to clarify and possibly revise the proposed amendments prior to sending them back to the members at a future date. The Board will be considering the helpful comments we have received from many of you and we will hopefully be able to work with one or more of the persons who signed the letter of opposition that was sent to you on September 25, 2003.

CG-ELKHORN REDEVELOPMENT
We have had recent conversations with the current owners of the former Elkhorn Hotel property. They now have direction from the City of Sun Valley regarding the requirements for redevelopment and are moving forward with a master plan. The SVEA Planning Committee may see that master plan as soon as the end of October. If the Planning Committee approves the master plan, more detailed plans will be prepared and submitted to the City Planning & Zoning Commission and the SVEA Architectural Design Committee. Approval from both of these entities will be required.

PONDS AND WINTER ICE
With the approaching winter temperatures we want to remind you of the dangers of thin ice. Please supervise children and pets around the many waterways and ponds in Elkhorn.

CROWN RANCH
On August 21st, the Board of Directors heard Crown Ranch’s appeal of the ADC denial of the Phase V project. The applicant/appellant was able to provide additional and more detailed information to the Board than had been presented to the ADC. Therefore, the decision of the Board was to remand the application to the ADC asking that they review the additional information. The applicant has not resubmitted plans for ADC review. It is our understanding that plans showing a reduction in units, from 13 to 11, have been submitted to the Sun Valley Planning and Zoning Commission.

POOLS/SPAS
The Village Pool closed for the summer season following the Labor Day weekend. The Harker Pool closed for the season on October 7th. The scheduled closing was set for September 30, however, due to the continuing warm temperatures and the number of owners enjoying the pool, the closing was delayed. We hope you had an opportunity to spend time at the wonderful Elkhorn Pools. The Pool Committee will be meeting this fall or early winter to begin planning for next summer. The Winter Spa operations will begin on November 28th with the opening of the Village. The hours of operation will be from 3:00 p.m. until 9:00 p.m. daily through mid April. Due to the low number of users over the past two winters, the Harker Spa will be operating for the Christmas holidays only, or December 20th through January 4th. The hours will be from 3:00 p.m. until 9:00 p.m. daily.

Remember, you and your guests need a valid amenity card to gain access to the spas. Check your card to make sure it is up-to-date and please call the office to request guest passes as required.

HOLIDAY LIGHTING
Just a reminder! Your seasonal lighting is subject to the SVEA Exterior Lighting Guidelines. "Decorative holiday lighting used on the exterior of buildings and in plantings is permitted during the winter months from November 1st until March 15th, provided a timer is used to insure that the seasonal lighting is turned off by 11:00 p.m. each evening". The document also states that the use of seasonal lighting shall be kept to a minimum so as to meet the intent of the Exterior Lighting Guidelines. Thank you all for complying.

SUN VALLEY CITY ORDINANCES
The City of Sun Valley is continuing their work on drafting and adopting a Hillside Ordinance. A Planning & Zoning Commission workshop to discuss the City Lighting Ordinance has been scheduled for October 14, 2003 and a Public Hearing has been scheduled for October 28, 2003.
