Annual Meeting Report
The SVEA Annual Meeting was held on December 30, 2003 in the Sun
Valley Inn. Unfortunately, a quorum was not established as only 49% of
the membership was represented in person or by proxy. The informational
portions of the agenda were presented with comments and questions taken
from those in attendance. The meeting was adjourned until January 2,
2004 where a quorum requirement of 25% of the membership constituted a
quorum. The minutes of the December 30, 2002 Annual Meeting were
approved and the election of Directors was completed with Ron Davis,
John O’Connor and Fred Williams being elected to the Board.

Audit
The audited financial statements of fiscal year ending October 31,
2003 have been completed. You may review the document on the SVEA
website (http://www.elkhorn-assoc.org/Audit_Report_2003.htm) . If you do not have access to a PC and
would like a copy sent to you, please contact the office.
Elkhorn Springs
CG-Elkhorn
representatives presented a Conceptual Master Plan to SVEA members on
December 30, 2003 and again on January 14, 2004. For those of you who
were unable to attend one of the presentations, the plan summary is
included with this newsletter. As their plan indicates, there will be a
total of 140 residential units, consisting of 128 market rate units and
12 designated as affordable housing. Also included is approximately
10,000 square feet of commercial space which is planned to include a
restaurant, a sales office and a general store which at this time is
planned to house a coffee shop, deli, video rental, ski/bike rental and
a full service post office. They are also planning to incorporate some
of the underground water for surface water features and will be setting
aside a fairly large portion of the old Plaza area as green space. A
portion of this master plan, the Golf Clubhouse, has been reviewed and
approved by the SVEA Architectural Design Committee.
Community School
Last
fall The Community School filed a complaint seeking a declaratory
judgment and quiet title in the Sagewillow Campus, basically contending
that SVEA has no legal interest in the property because it was not
properly annexed into Elkhorn and that the Master Declaration is not a
valid encumbrance on the property. This action was initiated after the
Architectural Design Committee denied the School’s application for
approval and after years of conduct inconsistent with the legal position
expressed in the complaint. SVEA answered denying the claims that the
Sagewillow campus is not part of Elkhorn and asserting numerous defenses
including the failure to join indispensable parties, estoppels, waiver
and ratification.
At its December meeting, the Board
voted to vigorously defend its interest in the Community School
Sagewillow Campus. We have responded to the Community School’s initial
discovery requests and are in the process of preparing initial discovery
requests to the Community School as well as subpoenaing relevant
information from third parties. The Court has not entered a Scheduling
Order and no trial date has been set.
2004 SVEA Board Meetings & Summer Picnic
The scheduled Board Meetings for 2004 will be held at the Harker
Center at 9:00 a.m. on April 2nd, July 1st,
October 1st, and December 29th. Board meetings are
open to Elkhorn Members. The Summer Membership Meeting and Picnic will
be held on July 2nd at 5:30 p.m. Watch your mail in April for
details of the Meeting and the Picnic.
Dark Sky
The Dark Sky issue continues to be an important one for many Elkhorn
residents. Since their inception, the SVEA Exterior Lighting Guidelines
have played an extremely important role in controlling many situations
of light trespass. The City of Sun Valley is working toward finalizing a
Dark Sky Ordinance that will also protect the night sky. Most of the
situations in Elkhorn that were non-complying have been remedied with a
simple reminder letter. Unfortunately, some are requiring the actual
violation process.
EXTERIOR HOLIDAY LIGHTING IS PERMITTED FROM NOVEMBER 1ST
UNTIL MARCH 15TH BUT MUST BE TURNED OFF BY 11:00 P.M. EACH
EVENING.
Winter Spa Operations
Many
owners and guests are enjoying the Village spa, sauna and steam-room
this winter. This facility will remain open for the duration of the ski
season and may be accessed with a valid amenity card. You may arrange
for cards for any guest physically staying in your Elkhorn property by
contacting the office.
Electronic Communications
We continue to collect e-mail addresses from those of you who are
coming to the office to renew your amenity cards or for other reasons.
Many have requested that the newsletter only be sent to them
electronically. If you have not yet provided your address, but would
like to, please e-mail us at
SVEA@cox-internet.com . Also, remember the website at
http://www.elkhorn-assoc.org. Your comments and suggestions for improving the
site are welcome.
Ponds and Thin Ice
The harsh bite of winter temperatures are, for the most part, behind
us. With this comes a very dangerous time for those persons and animals
living or playing around ponds and waterways. Ice that seems to be solid
and safe may not be. Please supervise children and pets, and warn your
"fair climate living" guests of the danger.
Sun Villa
Many
of you are interested in the proposed Sun Villas project. Though plans
have not been submitted to SVEA for architectural review, the project is
being considered at the City of Sun Valley. On February 24, 2004 Sun
Valley Planning & Zoning (P&Z) Commissioners heard from the project’s
representatives that they plan to reduce the overall number of units
from 97 to 81, reduce the height of the two north buildings, increase
the setback along the property line they share with Indian Springs and
move the trash collection to the interior parking area. P&Z took no
action except to request revised plans be submitted for review on
Tuesday, March 23, 2004.
